These Terms of Service govern your use of the ForeBuild platform. By creating an account, starting a free trial, or accessing any part of the service, you agree to be bound by these terms. If you do not agree, do not use ForeBuild. If you're agreeing on behalf of a business, you represent that you have authority to bind that business.
ForeBuild is operated by ForeBuild Pty Ltd ABN 73 696 611 024, a company registered in New South Wales, Australia ("ForeBuild", "we", "us", "our"). These Terms of Service ("Terms") form a legally binding agreement between you (or the business you represent, "you", "your") and ForeBuild.
These Terms apply to all products under the ForeBuild brand including ForeBuild for Tradies, ForeBuild for Builders (when available), and any future products. Where a specific product has additional terms, those will be disclosed at the time of subscription.
ForeBuild provides an AI-powered job pipeline and construction intelligence platform that aggregates and analyses publicly available development application data, industry news, and market signals to deliver tailored job alerts and intelligence to construction industry participants in NSW, Australia.
Depending on your subscription plan, the service may include:
We reserve the right to modify, suspend, or discontinue any feature or aspect of the service at any time. Where a change materially reduces the value of your current plan, we will provide at least 30 days' notice and offer a pro-rata refund for any prepaid period affected.
To use ForeBuild you must:
You are responsible for all activity that occurs under your account — including activity by any team members you grant access to under Business tier plans. You must notify us immediately at info@forebuildaustralia.com if you become aware of any unauthorised access to or use of your account.
We reserve the right to refuse registration or terminate accounts at our discretion, including where we believe information provided is false or misleading.
We offer a 7-day free trial of the ForeBuild platform on selected plans. The following conditions apply:
Paid subscriptions are billed monthly in advance. By subscribing, you authorise ForeBuild to charge your nominated payment method on a recurring monthly basis on the same date each month until you cancel. All prices are in Australian Dollars (AUD) and include GST where applicable.
If a payment fails, we will attempt to retry the charge over the following 7 days. If payment cannot be collected after multiple attempts, your account will be suspended. You will be notified by email throughout this process. Your account data is retained for 30 days during suspension.
You may cancel your subscription at any time through your account settings or by emailing info@forebuildaustralia.com. Cancellation takes effect at the end of your current billing period — you retain full access until that date. We do not offer refunds for partial months or unused periods, except as required by the Australian Consumer Law.
We may change subscription pricing at any time. We will provide at least 30 days' written notice before any price increase takes effect for existing subscribers. You may cancel before the new price takes effect without penalty.
We do not offer refunds for change-of-mind cancellations on monthly subscriptions. If you believe there has been a billing error, contact us within 30 days at info@forebuildaustralia.com and we will review your case promptly. Refunds required under Australian Consumer Law are always honoured.
You agree to use ForeBuild only for lawful purposes and in accordance with these Terms. You must not:
Violation of these requirements may result in immediate account suspension or termination without refund.
All platform software, algorithms, visual design, trademarks, brand elements, and proprietary data models are the exclusive property of ForeBuild Pty Ltd or its licensors. Nothing in these Terms grants you any ownership in our intellectual property beyond the limited right to use the service as described.
Intelligence reports, job alerts, AI summaries, and bulletin outputs generated by the platform are provided for your internal business development use only. You may not republish, resell, redistribute, or commercialise outputs from the platform without our written consent.
The "FOREBUILD" name and logo are trademarks of ForeBuild Pty Ltd. You may not use our brand assets without express written permission.
You retain ownership of any content you submit to the platform (such as research queries or custom templates). By submitting content, you grant us a limited, non-exclusive licence to process that content solely for the purpose of providing the service to you.
ForeBuild aggregates data from publicly available sources including NSW government planning portals, council registers, industry publications, and market data providers. While we take reasonable care to ensure accuracy and timeliness, we make no warranty that information provided through the service is complete, accurate, current, or fit for any particular purpose.
ForeBuild provides job intelligence and market information — not professional advice. Nothing in the platform constitutes legal, financial, planning, tendering, or business advice. You should conduct your own independent due diligence before making any business decision based on information from ForeBuild. We are not liable for any loss resulting from reliance on platform outputs.
Builder contact details provided through the platform are sourced from publicly available sources and may not always be current or accurate. You are responsible for verifying contact information before use.
To the maximum extent permitted by Australian law, ForeBuild provides the service "as is" and "as available" without any express or implied warranties. We do not warrant that:
Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law that cannot be excluded or limited by agreement.
To the maximum extent permitted by law, ForeBuild's total liability to you for any claim arising from or related to the service — whether in contract, tort (including negligence), or otherwise — is limited to the total fees you paid to us in the 3 months immediately preceding the event giving rise to the claim.

These limitations apply even if ForeBuild has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless ForeBuild Pty Ltd and its directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the service in violation of these Terms; (b) your violation of any applicable law or third party rights; or (c) any content you submit through the platform that causes harm to a third party.
Either party may terminate the service relationship at any time:
Upon termination, your access to the platform ceases. Clauses that by their nature survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — continue to apply.
These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising from or related to these Terms or the service.
Before commencing any legal action, you agree to first contact us at info@forebuildaustralia.com to attempt good-faith resolution of any dispute. We will respond within 14 days.
We may update these Terms from time to time. We will notify you of material changes by email and by posting a notice on the platform at least 14 days before changes take effect. Your continued use of the service after that date constitutes your acceptance of the updated Terms.
If you do not agree with a material change, you may cancel your subscription before the change takes effect and receive a refund for any prepaid period beyond the change date.
